Article 1: Definitions
In these terms and conditions, Jimmy’s uses the following definitions:
Jimmy’s : The movement concept and all activities offered to members under the name Jimmy’s .
The Jimmy’s location: The physical location where Jimmy’s is offered.
The Member: The individual (male/female), including minors, in whose name
the membership is registered.
The Minor: The individual (male/female) aged 12 to 16 in whose name
the membership is registered.
The Membership Card: The access card to Jimmy’s locations.
Article 2: General Information
As a concept, Jimmy’s is a registered trademark and part of a chain of fitness clubs in Morocco.
All contracts concluded by Jimmy’s are subject to Moroccan law. In the event of a dispute, only the court in the jurisdiction where the establishment indicated on the membership agreement is located will have jurisdiction.
Jimmy’s is committed to following the “Fitness Industry Code of Conduct” and therefore also accepts the out-of-court dispute resolution process as included in the Code of Conduct, should the Member wish to invoke it.
Registration (including for any add-on) is done via:
A completed online registration form.
A completed and signed paper registration form.
After online registration, the member must come to the club to sign their contract. The contract then becomes final.
During opening hours, the member may train at the club of their choice, respecting the applicable internal regulations.
The member may only access the club facilities upon presentation of a valid membership card.
Jimmy’s reserves the right to request identification from any person upon registration.
Article 3: Contract
These terms and conditions apply to all Jimmy’s services.
Jimmy’s reserves the right to modify the general terms and conditions of the contract at the end of the minimum commitment period.
Article 4: Membership
Membership and the obligation to pay begin on the effective date indicated by the member upon registration.
The member is informed that their membership is valid for the agreed contractual term, which begins on the contract’s effective date.
The member may not, under any circumstances, transfer their membership contract to a third party.
If the participant does not receive the training as agreed upon in their Jimmy’s registration, they are not entitled to any refund of the membership fee, nor to any exemption from payment of the amounts due.
If Jimmy’s offers the option to purchase a Day Pass, Jimmy’s will determine how this Day Pass can be purchased. The Day Pass has a limited validity period. The single-use Day Pass grants access to one club of the individual’s choice within the purchased pass.
Young people aged 12 to 17 can train at Jimmy’s if they possess a valid membership card. However, they may only access our facilities if accompanied and under the responsibility of a member aged 18 or older who trains with them and also possesses a valid membership card. The membership application must be submitted by the parent/legal guardian, who must also sign the contract.
Article 5: Membership Fees
Membership fees can be paid either in cash, by card payment terminal, or by check.
Article 6: Privacy
Jimmy’s complies with the provisions of the law relating to the protection of privacy regarding the processing of personal data.
The data controller for the member’s personal data is Jimmy’s.
If the member provides their personal data to Jimmy’s, this data will be recorded in Jimmy’s database and processed for the purposes of managing the customer file, the products and services offered, conducting market research, informing the member of new products and services, and implementing promotional and informational campaigns. Personal data will not be transmitted to any third party, with the exception of companies affiliated with Jimmy’s involved in the execution of the membership agreement.
Article 7: Membership Card
The membership card is personal. It grants access only to the Member and may not be transferred to a third party under any circumstances.
The member remains responsible at all times for the use of the membership card.
Jimmy’s is authorized to refuse access to the member in the event of misuse of the membership card.
The loss or theft of the membership card must be reported directly to Jimmy’s.
Jimmy’s will be required to charge 129 DHS for the issuance of a new membership card.
Article 8: Termination of Membership and Fixed-Term Suspension
The member has the right to suspend their training for a specified period. However, the refund is limited to one month and is only possible under these two conditions:
Annual membership; The reasons for suspension are medical or extreme.
To benefit from the recovery period, the Member must contact the following address: info@jimmys.ma and send, in addition to all necessary contact information, a scanned copy of their medical certificate as an attachment.
If the Member voluntarily terminates their contract, they are not entitled to a refund.
“Jimmy’s” may terminate the membership agreement to the detriment of the Member, without granting any right to any form of damages or compensation, if the Member fails to comply with the club rules.
Article 9: Opening Hours
“Jimmy’s” is authorized to close the clubs completely or partially on public holidays.
“Jimmy’s” reserves the right to temporarily or permanently modify the opening hours of a club (or parts thereof). At the time of signing the contract, the group class schedule and opening hours are indicative and subject to change. Given the number of registrations, Jimmy’s reserves the right to unilaterally modify opening dates and times. Class schedules and opening hours cannot be subsequently invoked as absolute conditions for signing a contract. Members cannot use these changes as grounds for terminating their membership, particularly since the company’s primary purpose is to provide its members with a fitness space and training equipment.
Jimmy’s is authorized to temporarily close one or more clubs for repairs and maintenance. However, members may train at other Jimmy’s clubs.
Some Jimmy’s clubs are open 24/7.
Article 10: Personal Data
Changes concerning the Member’s personal situation (e.g., address or bank details) must be communicated directly to “Jimmy’s” by email to the following address: info@jimmys.ma
Article 11: Personal Training
At several locations, “Jimmy’s” may offer “Personal Coaches” who provide private training sessions for an additional fee. The services of these “Personal Coaches” are not included in the membership fee.
In the event of a conflict or dispute with the personal trainer, “Jimmy’s” assumes no responsibility or involvement.
The client may not provide personal training to other clients.
Article 12: Liability
“Jimmy’s” disclaims all liability towards its members or any third party, except for its potential liability towards its members in cases of intent or gross negligence, and its potential liability in cases of death or personal injury to its members due to an act or negligence of “Jimmy’s”.
Each member is personally responsible for their own personal accidents and belongings.
Neither the company nor its employees can be held liable for any loss, damage, or theft of personal belongings within the club premises. Please always store your personal belongings in the lockers provided for this purpose.
Members do not have the right to request access to the security cameras. However, viewing them is contingent upon filing a report with the appropriate authorities, namely the police.
Jimmy’s is an independent entity from the Aquapark Wave complex. The latter is in no way responsible for Jimmy’s customers.
Article 13: Jimmy’s Club Rules
Members are hereby informed that Jimmy’s has reinstated its club rules. These rules are available on the website and can also be consulted at the club reception desk.
A Jimmy’s employee may refuse entry at any time to individuals whose behavior justifies a violation of these rules.
Jimmy’s reserves the right to confiscate a member’s card for valid and legitimate reasons (breach of trust, etc.) and to terminate membership without refund.
Members must respect the Jimmy’s brand without engaging in any actions detrimental to it.
Members must respect the Jimmy’s brand and all Jimmy’s staff, and must behave and communicate politely and respectfully, without being offensive or immoral. Otherwise, “Jimmy’s” will terminate the membership agreement permanently.
At the end of each workout, the Member must return the equipment used, without causing noise or disturbance to other members. Failure to do so may result in a warning or even permanent suspension.
Article 14: Final Provisions
Agreements between the Member and “Jimmy’s” can only be concluded and modified in writing.
If any of the preceding provisions are invalidated or found to be illegal, the remaining provisions shall remain in effect.
The Member’s signature on the front of this agreement constitutes full proof and gives legal effect to all clauses.
